3. Custom-Built Equipment & Electrical Components

Purchases of custom-built units—including Clean Stream, Clean Stream Pro systems, custom assemblies, electrical components, wiring, solenoids, boards, relays, and similar items—are subject to the following:

  • Build times may vary

  • Final appearance may differ slightly

  • You are responsible for correct installation and wiring

  • You assume full responsibility for safe and proper use

  • These items are non-returnable and non-refundable

We are not responsible for damage caused by installation errors, incorrect power sources, chemical exposure, or environmental conditions.

4. Chemical Purchases & Safety

By purchasing chemicals or detergents, you acknowledge:

  • You understand proper handling, dilution, PPE, and application

  • You will read all safety documentation (including SDS sheets)

  • You accept responsibility for property damage, injury, or misuse

Wash Pro Shop is not liable for chemical mixing mistakes, bodily injury, respiratory exposure, surface damage, environmental harm, or corrosion resulting from misuse.

5. Professional Use Warning

Our products are intended for trained users with knowledge of pressure-washing equipment and chemicals.
You assume all risks associated with:

  • High-pressure systems

  • Remote control systems

  • Chemical injection equipment

  • Soft wash systems

  • Surface cleaning

  • Roof washing

  • Electrical hookups

Improper use can result in injury, property damage, fire, or equipment failure.

6. Payment Terms

By placing an order, you agree:

  • To provide accurate billing information

  • You are authorized to use the selected payment method

  • You will not file fraudulent disputes or chargebacks

  • To pay all fees, including shipping, restocking, or diagnostic costs

Fraudulent chargebacks will be disputed with full evidence.

7. Shipping & Delivery

All shipping timelines are estimates. Once a package is handed to the carrier:

  • We are not responsible for delays

  • We are not responsible for damage caused during transit

  • We are not responsible for lost or stolen packages

  • Customers must file claims directly with UPS, USPS, or FedEx

Incorrect addresses provided by the customer are their responsibility.

8. Risk of Loss

Risk of loss transfers to the customer once the carrier scans the package as accepted.

9. Returns, Refunds & Cancellations

All returns, refunds, and cancellations follow our Return & Refund Policy, which is incorporated into these Terms.

Key points include:

  • Many items are non-returnable

  • Unauthorized returns will be refused

  • Restocking fees apply

  • Custom items cannot be cancelled once payment is processed

Purchasing from Wash Pro Shop indicates agreement to these conditions.

10. Website Accuracy & Availability

Wash Pro Shop does not guarantee:

  • The site will operate without interruption

  • Content will remain available at all times

  • Prices or listings will be error-free

  • Website changes will be communicated beforehand

We may update or remove content at any time.

11. Intellectual Property

All content on WashProShop.com—including product names, images, videos, logos, descriptions, manuals, and branding—is protected by copyright and trademark law.

You may NOT:

  • Incompatible chemical mixtures

  • Tank contamination

  • Injector failure due to chemical misuse

These risks are inherent to pressure-washing and chemical handling.

14. Limitation of Liability

To the fullest extent allowed by law:

  • Wash Pro Shop is not liable for indirect, incidental, special, or consequential damages

  • Our total liability is limited to the amount paid for the product involved

  • We are not liable for lost income, property damage, business interruption, or personal injury

This applies even if we advised you of the possibility of such damages.

15. Indemnification

You agree to indemnify, defend, and hold harmless Wash Pro Shop and its owners, partners, employees, and affiliates from any claims, damages, losses, liabilities, legal fees, or expenses arising out of:

  • Your misuse of products

  • Installation errors

  • Chemical misuse

  • Violation of these Terms

  • Third-party claims related to your actions

16. Governing Law & Jurisdiction

These Terms are governed by:

The laws of the Commonwealth of Kentucky

Any disputes must be resolved exclusively in:

Knox County, Kentucky

You agree to the jurisdiction of Knox County courts.

17. Mandatory Arbitration Agreement

Except for small claims cases:

  • Any dispute must be resolved through binding arbitration

  • Arbitration will be conducted under Kentucky law

  • Arbitration is individual, not class-based

  • Arbitration replaces the right to sue in court

Both parties waive the right to a jury trial.

18. Class Action Waiver

By using this site, you waive the right to:

  • Participate in a class action lawsuit

  • Act as a class representative

  • Join claims with others

All disputes must be handled individually.
